Getting Records from Other Doctors

Under the HIPAA regulations, a provider MAY share patient information with other members of the care team without patient permission.  This is considered an allowable disclosure.

Just because the provider may, does not mean they are required to.   When you request records from another doctor you may run into situations where other provider requires a written patient authorization to share those records with you.   In that case you will need to get an authorization from the patient.  You may want to make a phone call and let the other provider know it is not a HIPAA violation to share that information with you and educate them about HIPAA.   A good reference can be found here:

Another approach would be to modify your intake forms and at the time the patient fills out those forms, have them sign a form authorizing any other medical provider to share information about the patient with your office.
